1. Agreement to Terms

By accessing and using Lullaby AI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These terms apply to all visitors, users, and others who access or use the Service. Your continued use of the Service constitutes acceptance of any modifications to these Terms.

2. Service Description

Lullaby AI is an iOS application that provides AI-powered personalized lullaby generation services. Our Service includes:

• AI-Powered Lullaby Generation: Personalized lullabies based on baby information and preferences
• Multi-Language Support: 14+ languages for lyrics and voice generation
• Music Styles & Themes: Various musical styles including Sleep, Nature, Love, and traditional themes
• Audio Playback & Storage: Local and cloud storage of generated lullabies
• Traditional Lullabies Library: Curated collection of traditional lullabies
• Premium Features: Advanced features for premium subscribers

The Service is intended for parents and guardians to create personalized lullabies for their children. It is not a substitute for professional medical or childcare advice.

3. Account Terms

To use certain features of the Service, you must create an account. By creating an account, you agree to:

• Be at least 18 years old or have parental consent
• Provide accurate, current, and complete information
• Maintain and update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use
• Use only one account per person or legal entity

4. Subscriptions & Payments

Premium Features Include:

• Unlimited lullaby generation
• Ad-free experience
• Offline playback capability
• Premium voice options
• Background audio playback
• Up to 500 lullabies per year
• Extended duration options
• Priority customer support

Payment Terms:

• Subscriptions automatically renew unless cancelled
• Prices are subject to change with 30 days notice
• Refunds are handled according to App Store policies
• All payments are processed through Apple's App Store
• Subscription management is handled through RevenueCat

5. Acceptable Use

You agree NOT to use the Service to:

• Create content that is illegal, harmful, or inappropriate
• Generate content that violates intellectual property rights
• Attempt to reverse engineer or hack the Service
• Use automated systems, bots, or scripts
• Share account credentials with others
• Attempt to bypass usage limitations or restrictions
• Use the Service for commercial purposes without permission
• Collect or harvest user data without consent
• Interfere with the Service's security or performance

6. Content & Intellectual Property

Your Content:

• You retain rights to your input data (baby information, preferences)
• Generated lullabies are for personal, non-commercial use
• Commercial use requires written permission from Lullaby AI
• You grant us license to use feedback for service improvements

Our Rights:

• We retain rights to the AI models, algorithms, and technology
• The Service interface and design are our intellectual property
• Traditional lullabies library is curated and owned by us
• We may use anonymized data for service improvement

7. Privacy & Data Protection

Your privacy is important to us. Our data collection and usage practices are detailed in our Privacy Policy, which is incorporated into these Terms by reference.

• We comply with COPPA (Children's Online Privacy Protection Act)
• We follow GDPR (General Data Protection Regulation) standards
• All data is encrypted in transit and at rest
• We do not sell personal information to third parties
• You have rights to access, correct, and delete your data

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind. We specifically disclaim:

• Warranties of merchantability or fitness for a particular purpose
• Guarantees of uninterrupted or error-free service
• Accuracy of AI-generated content
• Compatibility with all devices or operating systems
• Security of data transmission or storage

The Service is not a substitute for professional medical, childcare, or educational advice.

9. Limitation of Liability

To the maximum extent permitted by law, Lullaby AI shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of data, profits, or business opportunities
• Damages resulting from unauthorized access to your account
• Service interruptions or technical failures
• Content generated by third-party AI services

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

We may terminate or suspend your account if:

• You violate these Terms
• You engage in fraudulent or illegal activities
• You fail to pay subscription fees
• We discontinue the Service

You may cancel your account at any time by:

• Using the account deletion feature in the app
• Contacting our support team
• Cancelling your subscription through App Store

Upon termination, your right to use the Service ceases immediately, but certain provisions of these Terms survive termination.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through:

• Email notifications to registered users
• In-app notifications
• Updates to this document with new effective dates

Your continued use of the Service after changes constitutes acceptance of the new Terms. If you disagree with changes, you must stop using the Service.

12. Governing Law & Disputes

These Terms are governed by the laws of California, United States. Any disputes shall be resolved through binding arbitration in San Francisco, CA, except for claims that may be brought in small claims court.
